Victory against money-lenders for garnishees

Businesswoman and owner of DeMorgenzon wine farm, Wendy Appelbaum, took on unscrupulous money-lenders and has won a major battle for the poor!

I remember a few years back Wendy told me about this case that she was taking on to assist her workers.

It is now 2.5 years later, and after many hours of pro bono work by Webbeer Wentzel, Wendy and many others, these workers and thousands (probably millions) of those who have been taken advantage of, will benefit from a ruling by Judge Desai, who ruled on Wed 8th July in the Western Cape Hight Court that that the system for granting emoluments attachment orders (EAO) in South Africa leads to the abuse of human rights by business enterprises and is unconstitutional.

Speaking to Wendy after the ruling she was over the moon - she could not believe how incensed Judge Desai was. 'Á great victory for the poor'! she exclaimed!

Desai highlighted some examples where loans are granted and the repayments exceed 50% of their income. “These were quite obviously reckless loans and unsurprisingly the applicants defaulted on their repayments,” he states.
